احکام قتل نفس در قرآن
پرسش:
مِن اَجلِ ذالِکَ کَتَبنا عَلي بني اِسرائيلَ اَنَّهُ مَن قَتَلَ نَفساً بِغَيرِنَفسٍ اَوفَسادٍ فِي الاَرض فَکَاَنَّما قَتَلَ النّاسَ جميعاً............... هر که بيگناهي را بکشد، مثل اينست که يک جامعه را کشته.بعضي ها کشتندو گفتند اگر بي گناه باشد ميرود بهشت و ...اولاً بهشت رفتن کشته شده بيگناه، کشنده را تبرئه نميکند و او(نزد خدا) محاکمه خواهد شد،ثانياً کشنده بيگناه ، يک جامعه را کشته و براي يک جامعه مجازات خواهد شد،ثالثاً کسانيکه ميتوانستند حکم او را باطل کنند و نکردند، شريک جرم خواهند بود
پاسخ:
با سلام و تشکر از حضور شما
قتل و کشتن بيگناه همان گونه که در آياتي که آورده ايد ، تذکر داده شده ، از بزرگ ترين گناهان است . در هيچ جاي دين نيامده که فردي را بکشي و توجيهت اين باشد که اگر بي گناه است، به بهشت مي رود. اگر افرادي بي ايمان در گوشه اي از جهان چنين حرف مزخرفي مي زنند، نبايد آن را به حساب دين گذاشت.
اگر بيگناه کشته شود، گر چه به بهشت مي رود ، ولي قاتل مورد سوال واقع مي شود. قاضي که حکم را صادر کرده، اگر در صادر کردن راي دقت کرده و ادله را به خوبي وارسي نموده و بدون اين که تقصيري کرده باشد، در اثر اغواي ديگري به اشتباه افتاده و حکم را صادر کرده و تا آخر هم به اشتباه خود پي نبرده، بيگناه است . گناه به گردن کسي است که با ادله و مدارک جعلي قاضي را به خطا انداخته است . اگر تقصير کرده ، قاضي مقصر است.
بهشتي شدن مقتول بيگناه باعث پاک شدن گناه صادر کننده حکم نمي شود.
اگر هم بدون محاکمه کسي را کشته باشند، قاتل هر کس و در هر مقامي باشد ، مقصر است ، مگر اين که در قتل، عمدي نداشته ، به خطا و يا در جهت ايجاد نظم و امنيت عمومي بوده،
در اين جا چون قاتل عمد نداشته و در صدد اجراي ماموريت بوده و ناخواسته قتل واقع شده، بايد از بيت المال جبران شود . رضايت خانواده مقتول کسب شود . قتل خطايي در همه جهان اتفاق مي افتد.
