فایده قصاص چیست؟
پرسش:
فائده قصاص با توجه به آيه 179 سوره بقره چيست؟
پاسخ:
سلام خداوند بر شما
وَ لَكُمْ فِي الْقِصاصِ حَياةٌ يا أُولِي الْأَلْبابِ لَعَلَّكُمْ تَتَّقُونَ (بقره 179) و براى شما در قصاص، حيات و زندگى است، اى صاحبان خِرد! شايد شما تقوا پيشه كنيد.
اسلام حکم به قصاص نکرده، بلکه حقي است که براي صاحبان خون قرار داده، آن هم در کنار دو گزينه ديگر، زيرا وقتي خوني ريخته مي شود و يا جنايتي صورت مي گيرد، اسلام براي صاحب خون يکي از سه راه را قرار داده است :
1- عفو كردن بدون گرفتن خونبها.
2 - عفو كردن با گرفتن خونبها .
3 - قصاص كردن. اکنون با توجه به اين که قصاص راه سومي است که خداوند براي صاحبان خون قرار داده، به بيان برخي فايده هاي آن مي پردازيم :
1 - جلوگيري از تکرار جنايت : زيرا قاتل احتمال مي دهد که صاحبان خون به پول راضي نشوند و از او قصاص کنند، ولي اگر قصاص يکي از راه ها نبود، قتل زياد مي شد، زيرا در بسياري از قتل ها امکان پرداخت ديه تصور مي شود، همچنين زندان که بسياري از افراد با آن کنار مي آيند. غربي ها زندان را تنها راه اعلام نمودند و درهاى زندان ها را به صورت قانونى روى هر گونه مجرمى باز کردند. از آن گاه كه زندان قانون رسمى گرديد، تجربه و آمار نشان مي دهد كه جنايات افزايش يافته و بودجه دستگاه هاى قضايى و اجرايى و ساختن زندان ها و نگهدارى زندانيان پيوسته بيشتر مي شود. آيا عقل سالم و غير محكوم مي تواند بپذيرد كه چون فردى كشته شد يا مالش به سرقت رفت، ملتى محكوم است كه بودجه زندان قاتل و دزد را و پيش از آن دستگاه قضايى و انتظامى و نگهدارى آن را بپردازد؟! مي گويند: قانون زندان براى تنبيه و تربيت است ! مي گوئيم : در كشورهاى متمدن چند در صد به اين نتيجه رسيدهاند؟
آنچه از زندان هاى كشور خود مي دانيم اثر تنبيه و تربيت زندان درباره مجرمين فطرى و حرفهاى صفر است بلكه با آميزشى كه انواع مجرمين با هم دارند ،خوى جنايت و راه هاي آن ريشهدارتر و بيشتر مي گردد و در واقع دوره نهايى را طى مي كنند. بر فرض که در شرائط خاص اجتماعى و تربيتى و نسبت به بعضي مجرمين، زندان موجب تنبيه و تربيت باشد، براى همه و در همه جا نيست. (1) پس تنها عاملي که هيچ کس با آن کنار نمي آيد و از آن حساب مي برد ،مرگ است.
2 - حفظ حيات جامعه : نبودن قصاص مانند آن است که در پزشکي، قطع عضو، در هر صورتي ممنوع باشد، که عقلايي نيست، زيرا گاهي عضوي به گونه اي مي شود که اگر باقي بماند، ديگر اعضا را نيز معيوب کرده، صاحبش را نابود مي کند ، به همين سبب در پزشکي مقرر است که عضو معيوب حتي المقدور اصلاح شود و يا اگر امکان دارد، بيمار با آن بسازد، در غير اين دو صورت، عضو معيوب را، براي محافظت از ديگر اعضا، قطع مي کنند. نسبت افراد به جامعه هم نسبت عضو به بدن است، به طوري که اگر جز با کشتن شخصي ، جامعه از او در امان نمي ماند، و ماندنش باعث فساد جامعه مي شود، از نظر اسلام، که مانند جريان عضو مورد تأييد عقلا هم هست، بايد از بين برود .
3 - فرو نشاندن حس انتقامجويي : در ميان بسيارى از جوامع و قبائل اگر قاتل به حكم قانون قصاص نشود، حس انتقامجويى و دشمنى ميان قبيله و خويشان مقتول هميشه در كمين است تا فرصتى بيابد و موجب جنايات و كشتار شود.
4 - ايجاد آرامش روحي : باعث آسودگي و نوعي آرامش روحي و رواني در صاحبان خون مي شود .
5- عبرت بودن براي جامعه : بزرگ ترين عبرت براي ديگران اين است که قاتل را بر بالاي دار ببينند.
